The Gcantor <br />specifically and exprcssly waives any immunity under lndustrisl Insutance. Tide 51 RCW, and <br />aclrnowledqes that this waiver has been mutuallY nettotiated by the parties. <br />7. The Grantor also covenants to the Ciry that Grantor is lawfully seized and possessed <br />of 1he land aforesaid; has a good and lawful right end power to sell and convey same; that <br />same is free and clear of encumbrances, ezcept as above indicated; end that Grantor will <br />forever warranl and defend the title to said easement and the quiet possession thercof against <br />the lawful claims and demands of all persons whomscever. <br />8. The rights and obligations of the Grantor and City shall inure m the benefit of and be <br />binding upon their respective heirs, successors and assigns. <br />9.
