1. Chapter 19.^4 / B-1 / �Jeighborhood Shopping Zone. Specifically 19.24.020 (F). <br />Variance to install a pole sign 5' tall x 5'-0" x 4'-0" diaineter, 1.79 square <br />feet in excess of 30 square feet allowed. <br />In Fina� Declaration of Non-Significance, SEPA q82-60, dated November 2, 1382; <br />para9raph 17 refers to City of Everett Zoning Code effective this date: <br />"All signs erected shall be in compliance with the City of Everett Siyn Code <br />and the permissible square footage as stated in the B-1 Neigh6orhood Shopping <br />Zone, specifically as follows: <br />One lighted or unlighted sign, not to exceed thirty syuar•e feet in area <br />placed on the property for which the identifying or advertising message is in- <br />tended. Lighted signs shall not be of flashing or animated character. <br />No specific li�nitaLion on the �lacement or �� of advertising sign appears, <br />except that sign inust be "placed on the property". Size is limited per the <br />Code to 30 square feet per face. <br />Placement or typc of advertising sign do not appear in the SEPA q82-60 as <br />pr•epared by the City Planning Director because no such limitation appeared in <br />the Zoning Code. <br />Sometime after the SEPA Document was prepared, without any advance notice <br />to the restaurant developer, and having a copy of SEPA p82-60 on file as prc- <br />pared by the Flanning Uirector, for this subject property, the Planning Cum- <br />mission unalaterally approved a cnange in Section 19.24.020(F). <br />The Zoning Code as ammended limited the type of signs to wall or projectin�� <br />an�i pole signs to buildings with multi-tenant occupancies. <br />2. The Zoning Code in effect fer 4-1 zone at the time the Planning Director <br />prepared the Final Declaration of Non-Significance for approval of a restaurant <br />at this site did not limit the location of advertising signs. A pole or free- <br />standing sign was not restricted to buildings with mulit-tenant occupancies. <br />4pplication of ?he ammended Zoning Code to this site is to change conditions <br />and add restrictions not contained in the SEPA q82-60 or the Cverett Zoning <br />Code on November 2, 1982. <br />Itestricting the plac�ment and type of advertising sign deprives the property <br />owner of a right and privilege previously enjoyed by his and other property <br />owners in the D-1 zone. A clioice of placement and type of advertising sign <br />was allowed under the conditions as set forth in Che SEPA Docunient and the <br />[verett Zoning Code. <br />3. The variance requeste�i will not be detrimental to ti�e public wellfare or <br />injurious to the properties in the vicinity of the znne in which the property <br />is located.
