<br />[or sueh purposes. Grantor n]so authorizes the City to cut, trim end remove eny
<br />and all brush, trees, other vegetatfon and debris on Crentor's property which, in the
<br />City's rensonable judgment, constitutes a hazard to the easement tind the right of
<br />access for such purposes.
<br />4. Thp Grantor egrees thet title to all brush, trees, other vegetation or
<br />debrts trtmmed, cut and removed from the ensement pursuent to thls Agreement,
<br />and eLso all brush, trees, other vegetntion or debris trimmed, cut and removed from
<br />Grantor's land pursuant to thts Agreement is vested In the City, and that the
<br />consideration petd for conveytng snid eesement nnd righls hereln described Ss
<br />accepted as full compensetion [or all damages incidentel to the e.rercise of any of

<br />thereen and hold the City, Ita officers, employees and agents harmless from

<br />paragraph does not purport to indemn(fy the City against ltability for damages
<br />erising out of bodily (njury to persons or dcmeges to property ceused by or resulting
<br />frorr. the sole negligence of the Ctty, its o!ficers, employees end egents.
<br />7• The Crantor also covenant.; to en�i with the City that Grantor fs
<br />Idwfully seized end possessed of the land afareseid, has a go! d and lewful right and
<br />power to sell and convey s�me; lhat same Ls free ond cleer of encumbrances,
<br />except as above indiceted; and that Greutor will forever werrent end defend the
<br />title to sald easement and the quie; pr.ss��ssion thereof ageinst the Inwful claims
<br />and demands of all persors whomsoevnr.
