17 <br />4. The terms of the resolution are sufficient to mitigate the impacts of :he proposed rezone. <br />NUW, THEREFORE, BE IT RESOLVED that the Ciry Council of the City of E��erett declares <br />its ir,tent to rezone property located at Z225 1 l6th Street SE, a eicinity map of �vhich is attache�' <br />hereto as Exhibit "A,'• Gom R-1 (Sin¢le Family Detached Low Densitv) to B-1 (Neighborhood <br />Shopping), pursuant to the provisions of Section 41. f 60 of Ordinance No. 1671-89, as amended, <br />and the Council shall by Ordinance, effect such rezone upon being advi;ed that all of the <br />foliowing conditions, stipulations, limitations, and requirements contained in this Resolution <br />have becn met: <br />The future Jevelopment of the subject property be permitted only as part o[an inte¢rated <br />redevelopment with adjoining B-I zoned properties, to be further reciewed through the <br />Ciry's shoreline permit process. <br />2• There shall be no vehiculaz or pedestrian access permitted to the site throueh the abuttine <br />singlt family zoned property (Hauffproperty) located south of the subject property. � <br />3• The south boundary of the subject property (abuttine the Haul'f property) shall be fenced <br />with a solid fence eight feet in height constructed with a 6 foot wood fence ou a 2 foot <br />concrete or masonry base. <br />'1• 'Ihe 10 foot wide landscape buffer abutting the propeny to the south of the subject <br />property shall be pianted with landscaping with trees having a mix of ever¢reen and <br />deciduous vees forming a more substantial visual buffer than Type II landscapin¢ would <br />provide. Trees shall be a minimum height of 8 feet at the time of plantine. <br />5• The height of the commercial building on the subject property be limited to l9 feet, with <br />a-chitectural accents or features used to modulate the front facade of the building allowed <br />to have a height of up to 28 feet. <br />6• The pazking area proposed on the east side of the subject property have a minimum <br />setback of 18 feet from the south properry line (nbuning the Hauff property), to be <br />landscaped as described above in Condition #�!. <br />7. Construction must be commenced within two (2) years of the date of issuance of the <br />shoreline permit. An ertension of time may be authorized as provided by the State <br />Shoreline regulations. Conswction of buildings and of the site improvements required <br />by this Resolution shall be completed within five yEars of the date of issuance of the <br />shoreline permit. An extension of time may be authorized as provided by the State <br />Shoreline regulations. <br />8. Use of Property Inconsistent with this Resolution. If any use of the subject property <br />occurs which is inconsistent with the terms of this Resolution, either before, during, or <br />aher construction and installation of ail improvements required by this Resolution, this <br />Resolution shall become void and all entitlements to the uses permitted herein shall be <br />forfeited, and any use inconsistent with the R-I zoning of the property shall be deemed a <br />z 157 <br />
