�LAN/r/HG �4N0 <br />'OA�lMUNlTY CEIsEZOPA�fENT <br />July 31, 1992 <br />NOTICE OF CITY ACTION <br />C�er Creek Vesting Decision <br />Summarv of Da�isln; <br />The City of Everett Planning Department has recaived a request for a vesting <br />determination for the proposed Casper Creek multiple femily development proposal, <br />which will be loceted south of Silver Leke Road, approximately 750 feet west of <br />19th Avenue SE. Phase I of the development would consist of 110 townhouse <br />units on a 10.19 acre site. Phase II of the development would consist of 12 <br />townhouse units on an adjacent 1.2 acre site. A shoreline permit, SEPA review and <br />building permit applicetion are required for the proposed project. The Everett Zoning <br />Code contains a subsection which defines certain points in the lend use approval <br />process at which an applicant becomes vested. Section 44 8121 and Section 44B13) <br />of the Everett Zoning Code contain the vesting provisions for land use proposals <br />which require only a SEPA review and building permit epplication, and proposals <br />which require shoreline substantial development permits. <br />In accordance with Section 448 of the Everett Zoning Code, the Pianning Director <br />has determined that a SEPA epplicetion for Phase I of the Casper Creek proposal <br />was filed prior to the effective date of the ordinance which adopted the new Zoning <br />Code. The original Phase I application was for the construction of a 234 unit <br />apertment complex. Revisions to the original SEPA epplication have been filed, with <br />the current proposal being a 110 unit apartment/townhouse complex. At the time <br />the oiiginal SEPA application was filed, the City did not require the Applicant to <br />submit an application for a shoreline substantial development permit. It wes <br />determined thet the 200 foot shoreline jurisdictional boundary included the street <br />frontage improvements edjacent to the proposal. However, a Local Improvement <br />District (UD) wes proposed which would have constructed the frontege <br />improveme�ts, making the shoreline permit addressing those improvements the <br />responsibility of the City. At the current time, the City is not proceeding with the <br />LID, which means the applicent is responsible for installetion and permitting of those <br />street improvements. <br />In Januery 1990, the City oi Everett edopted a new Zoni�g Code. <br />In April 1992, representatives of the Washington State Department of Ecology <br />conducted field investigetions end defined the ordinary high water mark of Silver <br />l�ke. The delineation wes further to the south than shown on the maps historically <br />used by the City to define the ordinary high water mark.
