MITIUATION AGREEMENT <br />THIS AGREEMENT is made and entered into this i 7cn day of <br />�ecember, 1990 , beiween EVERETT SCHOOL DISTRICT NO. <br />("District") 2nd Schneider Homes, Inc., a W2shington corporation ("Developer"). <br />. .� <br />A. Developer has requested a project review for construction of 113 single family <br />dwelling units known as Casper Creek Town Homes (the "Project"), Ci�y of Everett F�ling <br />No. SEPA 92•89, located south of Sitver Lake, west ot 19th Avenue SE, Everett, <br />Washington and more partfcularly described as follows: <br />Legal Description: See attached - Exhibit A <br />8, The Slate Environmental Policy Act ("SEPA") providea processes and procedures <br />whereby major actions by slate and local agencies, including, but not limifed to, the <br />approval of building permits/plats, mzy Ge review@d to determine the nature and extent <br />oi their impact on the environment. Impacts on public services, including schools, are <br />environmental impacts for purposes of SEPA. SEPA requires 113 mitigation o1 adverse <br />environmental impacts. <br />C. The Project will b3 located in an area where school children residing therein will <br />be served by the District. <br />D. The District has identilied the impacts on the District that will be a direct result of <br />the construction o1 the Project. <br />E. The identified impacts include the projected addition of 52.09 students to the <br />District, 01 which 20.45 are unhoused. <br />F. The District projects that the middle/high school(s) serving the Project will be at <br />capacity when the students irom the Project enter school. As a result, the District will <br />have to provide space in portable classrooms and other school facilities in order to <br />house and otherwise accommodate these students. <br />G. Developer and the District have reviewed the mitigation measures reasonably <br />necessary to mNipate the Impacts directly resulting from the Prnject and have concluded <br />that the provlalone set forth below (n this Agreement constitute complete and appropriate <br />provisfons for full mk(pation by Developer of the identiiled (mpacts from the Projed on <br />the District. • , <br />H.
