Theal, we a%e hereby applying for a revision to the <br />C_ shoreline eubstantial Development Permit issued by the City <br />of Everett for ti�`e Charter .r.lub Apartment�;�.The �,lans for <br />tlie revised project ��owing a reduction in density from 255 <br />to 210 units have been previously submitted to you under <br />�c�parate cover, and are now on file with your offices. <br />1;r. Theal's letter states that even though the revised <br />proposal for the Charter Club Apartments may result in a <br />better project due to the reduction in impacts, it cannot be <br />approved without compliance with the permit revision <br />process. Although we continue to believe that no authority <br />exists to require a shoreline permit revision, and no such <br />revision is necessary, we have been left with no alternative <br />but to submit this revision application. I�y submitting this <br />d not waive any rights which may have <br />application, we o <br />�+ accrued under the existing Charter Club Shoreline <br />Substantial Development Permit, and reserve the right to <br />construct the project under the existing Shoreline <br />Substantial Development Per.mit. <br />Although we believe no revision should be required, we <br />believe that, as a result of the reduction in density and <br />proportionate reduction in impacts, the revised project <br />meets or exceeds all applicable City of Everett criteria for <br />issuance o: a shoreline substantial de��elopment peimit <br />revision. In accordance with City of Everett Ordinance <br />b 723-80 as amended Section 3.F, the requested <br />Num er , � <br />1� revision is well within the scope and intent of the original <br />'�'� permit.
