Permit Conditions <br /> 5 . <br /> General. <br /> 1. The alley closure area will be limited to an area approximately 20 feet by 20 feet located 2900 <br /> Colby alley east,immediately behind 2923 Colby Avenue(The Irishman Pub),for the purposes of <br /> expanding the restaurant food and beverage service area. <br /> 2. The alley closure will begin on 17 March 2010 at 8:00 a.m.and open on 18 March 2010 at 8:00 <br /> a.m. The area will be open for patrons from 17 March 2010 at 2:00 p.m.until midnight. <br /> 3. The closure area will be enclosed by temporary chain link fencing of at least 6 feet in height. <br /> 4. Access to the Wall Street Building parking garage must be maintained at all times. <br /> 5. The Irishman Pub may not represent or imply that the event is City sponsored or sanctioned. <br /> 6. At its sole option,City may verify concurrences by adjoining property owners; lack of <br /> concurrence by any adjoining property owner may be cause for revocation or non-issuance of <br /> permit. <br /> 7. Permit may be revoked at any time after issuance if,in the sole opinion of the City staff, <br /> satisfactory compliance with permit conditions is not achieved or maintained. <br /> 8. Material changes to The Irishman Pub's plan presented to the city as of February 10,2010 may <br /> only be made by The Irishman Pub with the City's approval. In its sole discretion,the City may <br /> withhold approval. The Irishman Pub acknowledges that such changes should be submitted <br /> sufficiently in advance to allow the City adequate time to review the proposed changes. <br /> 9. In the event any amendment or adoption of an ordinance takes effect before or during the <br /> event,The Irishman Pub shall comply with the requirements of such ordinance,even if such <br /> ordinance establishes different requirements than those described in these conditions. These <br /> permit conditions will be deemed to be amended by such ordinance. <br /> Health/Safety <br /> 10. The fenced enclosure will provide for at least one emergency exit. This exit will be staffed by <br /> one employee at all times that the enclosure area is open to the public to prevent entrance to <br /> the area through the emergency exit. <br /> 11. The fenced enclosure will be clearly marked using reflective traffic cones spanning every 24 <br /> inches over the travelled portion of the alley. Reflective tape must be affixed to the fencing <br /> running the length of the travelled portion of the alley at a height of 4 feet from the ground. <br /> 12. The Irishman Pub must clean up;the City will not provide cleaning equipment or labor. All dean <br /> up will be completed prior to alley opening,but no later than 8:00 a.m.on March 18,2010.The <br /> Irishman Pub will be charged for any fees related to clean-up if not completed to the satisfaction <br /> of the City. The City Street Department will conduct a clean-up inspection. <br /> 13. The permit and closures may be suspended or terminated for life/safety reasons or for failure or <br /> refusal to timely comply with reasonable direction by city personnel,such as police or fire,or <br /> failure to comply with permit conditions. <br /> 14. The Irishman Pub will provide sanitation facilities for the public and vendors that are reasonably <br /> adequate in quality and quantity. <br /> 15. The Irishman Pub must contact the Fire Marshal for final site review and comply with the Fire <br /> Marshal's requirements. The Irishman Pub will comply with the maximum occupancy <br /> established by the Everett Fire Marshall prior to the event. The Irishman Pub should contact the <br /> Fire Marshal's office to determine when information should be submitted in order for the Fire <br /> Marshal to have sufficient time for review and comply with the Fire Marshal's submission dates. <br /> 16. The Irishman Pub must obtain any required permits from and comply with alt requirements of <br /> the Washington State Liquor Control Board. <br /> Vendors <br /> 12 <br />
