9 AMENDMENT NO.1 TO PROFESSIONAL SERVICES AGREEMENT BETWEEN <br /> THE CITY OF EVERETT <br /> AND <br /> DCI ENGINEERS D'AMATO CONVERSANO INC. <br /> The City and DCI Engineers D'Amato Conversano Inc. agree to amend and modify their professional <br /> services agreement dated January 6th,2010 (the"Agreement") as follows: <br /> WHEREAS, DCI Engineers D'Amato Conversano Inc. and the City entered into an Agreement dated <br /> Janaury 6th, 2010 to provide engineering consulting services for the design of the Primary Clarifier <br /> Scum Tank Safety Platform at the Water Pollution Control Facility; and <br /> WHEREAS, additional design consulting and construction period support services are needed and the <br /> total amount of compensation stated in the Agreement is insufficient for the remainder of the project <br /> and an additional$8,500 of contract value is needed to complete the project; and <br /> and <br /> WHEREAS,the City of Everett requires continued assistance from DCI Engineers D'Amato <br /> Conversano Inc. for services as described in Exhibit A of this Amendment; <br /> NOW THEREFORE, the City of Everett and DCI Engineers D'Amato Conversano Inc. agree to <br /> amend and modify the Agreement as follows: <br /> 1. Paragraph 4(D)is modified to read as follows: <br /> 4(D). Total compensation, including all services and expenses, shall not exceed a <br /> maximum of Twenty Eight Thousand Seven Hundred Dollars($28,700.00). <br /> 2. Additional work is described in Exhibit A and Exhibit 13 to Amendment No. 1 <br /> 3. The effective date of this Amendment is May 1st <br /> 4. All terms, conditions and provisions of the Agreement remain in full force and effect except as <br /> expressly modified by this Amendment, <br /> 66 <br />
