EkSEMsNT AND RIGHT- OF-WAY <br /> THIS AGREEMENT made by and between JOHN HENRY rHOMPSO V <br /> and EMMA VIOLA THOMPSON, his wife, hereinafter referred to as the <br /> GRANTORS, and DONALD AEBB and MARY WEBB, his wife, hereinafter <br /> referred to as the GRANTEES, do agree as follows: <br /> WHEREAS, the Grantors are the owners of that certain real property <br /> situated in Snohomish County, State of Washington, described as: <br /> E- 1/2 of the W-1/2 of Government Lot 2, Pection 3, <br /> Township 28 North, Range 5 E. W. M. ; <br /> and <br /> WHEREAS, Grantees are the owners of that certain real ,,roperty situ- <br /> ated in Snohomish County, State of Washington, described as: <br /> Z- 1/2 of the l+ -1/2 of the SW-1/4 of the NE-1/2 of <br /> Government Lot 2, '�cction 3, Township 28 No,-th, <br /> Range 5 E. W.M. ; <br /> and <br /> k <br /> WHEREAS, the Grantees are the owners and possessors of the water- <br /> right upon that certain water line owned, maintained and operated by the <br /> City of Everett, a municipal corporation, and that the Grantees do not have I <br /> ready access to said pipe line for the purposes of affixing a water tap thereon <br /> to exercise said right; and <br /> ,VHEREAS, it is lite desire and mutual intention of the parties that the <br /> Grantors grant, convey and warrant unto the Granters a certain easement and <br /> right-of-way over and across the 11eet five (5) feet of t'.e above described <br /> property in return for the right to use the existing road which is on the property <br /> of the Grantees; Now, Therefore, <br /> IN CONSID4RATI0N of the n utual benefits to l:n derived by the parties <br /> hereto by the exchange of various rights in and to the properties above des- <br /> cribed, the Grantors hereby hargatn, sell, convey, transfer and deliver unto <br /> the Grantees a permanent easement and right-of-way, including the perpetual <br /> right to enter upon the real estate hereinafter described at any time that they <br /> may see fit and construct, maintain and repair an underground pipe-line and/or <br /> main for the purpose of conveying water over, across, through and under the <br /> � for7 <br />
