Maultsby Variance 20-86 <br /> Page -3- <br /> 3. Section 5C (14) (d) of the Subdivision Code states ac <br /> follows: <br /> Lots abutting arterials must have 120 <br /> feet of lot depth. All other lots shall <br /> have a minimum of 80 feet of lot depth, <br /> and must have orientation toward a <br /> public street. <br /> It is from thiq section the Applicant seeks a variance. <br /> 4 . The property that the Applicant desires to short plat <br /> fronts Broadway on the west property line. From the <br /> northwest corner to the northeast --orner of the plat, <br /> the boundary tapers and does not satisfy the 120 foot <br /> depth requirement. A copy of the short plat is attached <br /> hereto and by this reference is hereby incorporated as <br /> part of these findings. (Exhibit 3) <br /> 5. The average lot depth of lot !1 of the short plat is 108 <br /> feet. The average lot depth of lot i2 is 103 feet. <br /> (Giffen testimony) <br /> 6. in order for a variance to be grantad within the City of <br /> Everett, the criteria for the granting of a variance as <br /> set forth in Section 19.70. 060 of the Everett Municipal <br /> Code must be satisfied. That criteria include: <br /> 1. There must be exceptional or extraordinary <br /> circ-imstances or conditions applying to the <br /> subject property or as to the intented use thereof <br /> that do not generally apply to other properties in <br /> the same vicinity or zone; <br /> 2. Such variance must be necessary for the <br /> preservation and enjuyment of a substantial <br /> property right of the Applicant possessed by the <br /> owners of other properties in the same vicinity or <br /> zone; <br /> 3. The authorization of such variance will not be <br /> materially detrimental to the public welfare or <br /> injurious to property in the vicinity or zone in <br /> which the property is located; and <br /> 4. The granting of such vnriance will not adversely <br /> affect the Comprehensive General Plan. <br /> (Everett Municipal Code) <br />
