r <br />BOARD OF ADJUSTMENT <br />FINDINGS, CONCLUSIONS AND ORDER VARIANCE NO. 18-88 <br />Based upon the written request for a variance from the City's <br />zoning code by: <br />Jeffrey Gehrig <br />1329 63rd St. <br />Everett, WA 98203 <br />hereinafter referred to as "Applicant," for a variance from <br />E.M.C. 19.16.040, which limits the size of an accessory building <br />to a maximum of ten percent of the total lot area or 1,000 square <br />feet whichever is less, and <br />from E.M.C. 19.42.040, which allows accessory buildings in the <br />20 foot rear yard provided they do not cover more than fifty <br />percent of the 20 foot rear yard area. <br />on the following property commonly known as: <br />1329 63rd St. <br />The Applicant is proposing to construct a 1,700 square foot <br />garage and shop that will cover ten percent of the 17,000 square <br />foot lot instead of the 1,000 square foot maximum allowed by <br />code, and that will be located on the rear of the lot and cover <br />approximately 60 percent of the 20 foot rear yard area instead <br />of the 50 percent allowed by code. The new structure will <br />replace an existing 1,144 square foot shop that will be <br />demolished. <br />The Board of Adjustment, following a public hearing on said <br />application held on June 6, 1988 and further having reviewed all <br />testimony, makes the following Findings, Conclusions and Order: <br />.rf <br />That there have been exceptional or extraordinary circumstances <br />or conditions applying to the subject property or as to the in- <br />tended use thereof that do not apply generally to other <br />properties in the same vicinity or zone. <br />a. Finding: The subjec'� property consists of a 70 foot by <br />243 foot, 17,000 square foot lot with an existing single <br />family structure and a 1,144 square foot shop and carport <br />that is located sixteen feet from the house. The <br />Applicant is proposing to demolish the shop and carport <br />and replace it with a 1,700 square foot structure on the <br />rear of the lot. The new structure would cover ten <br />percent of the lot area and approximately 60 percent of <br />the 20 foot rear yard area. <br />The rear lot line abuts the City reservoir property and <br />there is an existing six foot high cyclone fence on the <br />property line. <br />The Applicant is proposing to replace the eisting shop <br />and carport for the following reasons: <br />
