Conclusion: Granting the variance is not necessary to <br />provide a property right possessed by others in the <br />vicinity and zone. <br />That the authorization of such variance will not be materially <br />detrimental to the public welfare or injurious to property in the <br />vicinity or zone in which the property is located. <br />a. Finding: It has been the experience of the City that <br />excessively large accessory structures in residential <br />zones have a tendency to eventually be usad for <br />commercial purposes even though not originally intended <br />for that use. The commercial uses are not compatible <br />with the residential neighborhood and degrades the area <br />if not checked. This causes long term enforcement <br />problems for the City. <br />b. Conclusion: Authorization of this variance will be <br />materially detrimental to the public welfare and <br />injurious to other property in the vicinity or zone. <br />That the granting of such variance will not adversely affect the <br />Comprehensive General Plan. <br />a. Flnding: The Comprehensive Plan designation is Single <br />Family Detached. Policies adopted May 22, 1984, call for <br />preservation of the character of single family <br />neighborhoods by maintaining minimum setbacks and <br />regulating lot coverage. <br />b. Conclusion: Granting this variance could adversely <br />affect the Comprehensive Plan as related to the use since <br />an accessory structure the size proposed is not typical <br />of single family areas and so would not maintain the <br />character of a single family neighborhood. <br />RECOMMENDATION: <br />DENY the variance as requested by the Applicant. The Planning <br />Staff would support granting a variance to allow a 1,144 square <br />foot accessory structure in the rear yard with the following <br />conditions: <br />1. The existing accessory structure shall be demolished. <br />2. Maintain a minimum five foot rear and side yard setback. <br />3. Obtain all necessary building permits. <br />4.
