older homes due to short platting. Although exact
measurements could not be obtained, some of the older homes
have existing outbuildings which do not appear to meet
current setback requirements.
Criterion No.4•
That the variance is the minimum necessary to allow the subject property
the general rights described in Criterion 3.
a. Findings: See Criteria 93.
b. Conclusions: See Criteria 43
Criterion No.S•
The granting of the variance is consistent with the goals and policies of the
Everett General Plan.
a. Findings: The Everett General Plan designates this property
as 1.2, Single Family Residential.
b. Conclusions: The proposed use of the subject property and
variance is consistent with the Everett General Plan.
Criterion No. 6:
The need for the requested variance is not the result of a self-created
hardship.
a. Finding's: The applicant states that the need for the requested
variance is not the result of a self created hardship. The spa is
only being put in because their doctor recommended that his
wife could be able to delay and reduce the effects of
rheumatoid arthritis by "exercising" in warin water.
Installation of a hot tub would have avoided variance needs
but would not provide for "exercise" area. Given the size of
the spa and the 30' length of the gas truck filling hose, the spa
was placed facing north. To avoid all unnecessary heat loss,
and exc.ss strain on the pumps, the boiler was placed in the
only sensible place. There was really no choice for the boiler
placement.
b. Conclusions: The location of the propane tank is not the
result of a self created hardship. Its location is restricted due
to the limited access to the rear yard area and the needs of the
re -filling and servicing trucks in addition to the Fire
Department locational requirements.
NOW, THEREFORE, the Board of Adjustment of the City of Everett does hereby order the requested variance
be GRANTED.
