Sand, Manager .' <br />liandican Rcouirements in Condominiums <br />As you knor:, we've run into some practical difficulties when <br />we try to apply the handicap requirement to condominiums. <br />The difficulties are that most of these units are pre -sold <br />and if they're not bein; purchased by handicapped persons, <br />these perspective purchasers do not want that design feature <br />incorporated. The developers cannot provide spec units for <br />sale designed for the handicapped as this type unit is al- <br />most impossible to sell to the regular customer. Until such <br />time as the state changes its rules and regulations or de- <br />velops some interpretations on this question, our policy will <br />be as follows: <br />If the developer can show that he has made every effort <br />to advertise that lie is willing to provide handicap <br />units to anyone desiring that type of facility, full <br />occupancy will be permitted without handicapped units. <br />Contacts or advertising such as demonstrate: by the <br />attached letter from the Mueller Group seems to me to <br />be an example of actions that the developer should take <br />prior to selling all his units. <br />This policy is based on Section 003 of the regulations for <br />barrier -free facilities, exception Q , "full compliance <br />would be impractical in the case of condominiums." <br />EBS:mjw <br />Attachment <br />
