COLE, Trustee (hereinafter referred to as "Cole"), <br />and PIONEER NATIONAL TITLE INSURANCE COMPANY, a California <br />corporation (hereinafter referred to as "Pioneer"�: <br />WHEREAS, Cole is the Beneficiary under that certain <br />Deed of Trust dated September 6, 1979, executed by Palmer <br />Berge, Trustee, as Grantor and Debtor, to Pioneet as Trustee, <br />which Deed of Trust was recorded September 19, 1979, on page <br />23 in Volume 1596 of the Official Records in the Office of <br />the County Recorder of Snohomish County, Washington, and <br />which Deed of Trust creates a lien and encumbrance against <br />certain real property situated in Snohomish County, Washinq- <br />ton; and <br />WEiEREAS, 0'Donnell, Briqham & Partners - Northwest, <br />a California General Partnership (hereinafter referred to as <br />the "Owner") has entered into an Easement whereby the Owner <br />has conveyed the following describe3 real property to the <br />City of Everett, a municipal corporation: <br />The Easterly 20.00 feet of the Northeast <br />Quarter of Section 111 Township 28 North, <br />Range 4 East W.M., lying southerly of <br />75th Avenue Southwest as shown on Survey <br />recorded in Volume 12 of Surveys at page <br />253, Records of Snohomish County, Wash- <br />ington <br />which property shall be uGed for the construction, recon- <br />struction and maintaining a sanitary sewer and appurtenances <br />thereto; and <br />WHEREAS, the said Easement was recorded in the <br />8201150115 <br />i �Q. <br />t,�k� � ,�.�i � ��. <br />va�17��cE 138 <br />:� <br />� <br />1 <br />■I <br />� <br />
