map. A proportionately equal volume of runoff must continue to be discharged to each <br /> drainage basin before and after development. <br /> 56. All collected surface water exiting the subject property must be conveyed to the nearest <br /> established, stable drainage course within the naturally occurring drainage basin. <br /> Drainage must be conveyed, either by pipe or by approved Swale, in a manner that will <br /> not result in erosion or flooding. Sufficient downstream information and analysis must <br /> be provided to enable the City to determine that this requirement is being met. Private <br /> easements will be required if conveyance must occur across private property. <br /> 57. The entrance to the site must be a street intersection type with standard curb ramps. <br /> Matching curb ramps will be required on the south side of Merrill Creek Parkway. <br /> 58. The driveway must have at least 525 feet of entering site distance. <br /> 59. A channelization plan must be approved by the Public Works Department showing <br /> right turn tapers and a left turn acceleration lane. <br /> 60. A continuous walkway and crosswalk system must be provided from Merrill Creek <br /> Parkway to all buildings. <br /> 61. Building height shall be a maximum of 70 feet. A modification of the R-3 building <br /> height standards is permitted under the authority of EMC Chapter 19.32. This <br /> modification to the height standard is subject to compliance with the mitigation <br /> requirements of MDNS #16-93 and this resolution of intent to rezone. <br /> 62. The storm drainage system shown on the proposed site plan is approved in concept <br /> only. Not enough information has been submitted at this time to determine whether the <br /> size, location, or configuration of the facilities shown will be adequate to meet City <br /> Standards. <br /> 63. All structures, including buildings, parking areas, retaining walls, and utility and <br /> drainage improvements must be located outside of any portions of the site classified as <br /> environmentally sensitive. No grading will be permitted in these areas. <br /> 64. Prior to approval of building permits on the site, additional geotechnical information <br /> must be provided which addresses soil bearing loads, recommended construction <br /> methods, drainage, and temporary erosion control. <br /> 65. The proposal must also comply with all other City Code and Ordinance requirements <br /> not specifically set forth herein. <br /> TIME LIMITS - Within a period of three years following the adoption of this Resolution of <br /> Intent to Rezone by City Council, the applicant shall file with the Planning Department a final <br /> development plan consistent with this agreement. <br /> 8 <br />
