RESOLUTION NO. <br /> 3874 ,4egyVZ7 <br /> AMENDMENT TO RESOLUTION # 3734, <br /> A RESOLUTION OF INTENT TO REZONE <br /> "HARRINGTON PROPERTY," 8220 BEVERLY BOULEVARD <br /> WHEREAS, the City Council adopted Resolution #3734 on January 27, <br /> 1993 ; approving a Resolution of Intent to Rezone property located at <br /> 8220 Beverly Boulevard from R-1 to B-1; and <br /> WHEREAS, Condition 9.a of said Resolution required the applicant to <br /> complete specified improvements by January 27 , 1994; and <br /> WHEREAS, the applicant has been unable to complete the required <br /> improvements and has asked for an extension of time for completion; <br /> and <br /> WHEREAS, the Planning Commission has reviewed the request for <br /> additional time to complete the specified improvements and has <br /> recommended that the City Council extend the date by which the <br /> required improvements must be completed to January 27, 1995. <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of <br /> Everett hereby amends Resolution #3734 as follows: <br /> Condition 9 .a, which reads: <br /> a. Use of Existing Structure for Commercial Purposes. If the <br /> existing structure on the premises is to be used for commercial <br /> purposes, the off-street parking, street improvements, <br /> landscaping and all improvements required by this Resolution and <br /> other City regulations shall be completed within one year of the <br /> date of approval of the Resolution of Intent to Rezone by the <br /> City Council . Upon completion of all improvements required by <br /> this Resolution, a rezone ordinance consistent with this <br /> Resolution shall be presented to the City Council for their <br /> consideration and approval . If the requirements specified herein <br /> are not completed within one year of the date of the adoption of <br /> this Resolution by the City Council, this Resolution shall become <br /> void and all entitlements to the uses permitted herein shall be <br /> forfeited, and any use inconsistent with the R-1 zoning of the <br /> property shall be deemed a violation of the zoning code and be <br /> subject to the violation, enforcement and penalty provisions <br /> thereof. <br />
