E11dRETT CITY OF EVERETT RESOLUTION NO. c0rc A RESOLUTION for waiving the public bidding requirements and for the sole source purchase from Stagecraft Industries, Inc., for additional equipment which must be compatible with existing equipment already installed in the Everett Community Theater. WHEREAS,the Everett Community Theater has a need for additional equipment (fly rigging , lighting, etc.)with specific and unique requirements which only Stagecraft Industries can provide so that warranties of existing equipment are not at risk; and WHEREAS, the Everett Community Theater has evaluated the equipment needs of the technical infrastructure and made the judgment as to compatibility between the existing equipment and the additional equipment; and WHEREAS,the Everett Community Theater has identified that"Stagecraft Industries, Inc." supplied the existing equipment and must supply the additional equipment in order not to invalidate existing warranties,which in turn,best serves the City's needs;and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVERETT, the City hereby finds that the purchase of "Stagecraft Industries, Inc." brand equipment for the City's Everett Community Theater is legitimately limited to a single supplier by reasons of existing warrantties, waives the requirement of calling for public bids for the acquisition of the subject technical equipment. Pursuant to RCW 35.23.352(9),the City hereby waives the requirement of calling for public bids for the acquisition of the subject equipment. The City further finds the purchase is clearly and legitimately limited to a single source or supply and that the technical equipment is subject to special market conditions.
