OIP EV/ERETT st CITY OF EVERETT RESOLUTION NO. c5O oI.5 A RESOLUTION for waiving the public bidding requirements and for the sole source purchase from Moe's Pianos, for a concert Steinway CD 198 Piano for the Everett Community Theater. WHEREAS, the Everett Community Theater has a need for a concert piano with specific and unique requirements which only one supplier has for purchase; and WHEREAS, the Everett Community Theater has evaluated the Concert Steinway CD 198 Piano and made the judgment as to suitability for the concert artists who will be performing at the theater; and WHEREAS, the Everett Community Theater has identified that "Moe's Pianos" as the sole source for the Steinway CD 198 which will best serve the City's needs; and WHEREAS, the Everett Community Theater has prepared a memorandum outlining the reasons why "Moe's Pianos" Steinway CD 198 is unique in terms of meeting the Everett Community Theater's special needs in a concert piano. Said memorandum is attached hereto and incorporated by this reference. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVERETT pursuant to the attached memorandum, the City hereby finds that the purchase of a Concert Steinway CD 198 from "Moe's Pianos" for the City's Everett Community Theater is legitimately limited to a single supplier, waives the requirement of calling for public bids for the acquisition of the subject Piano. Pursuant to RCW 35.23.352(9), the City hereby waives the requirement of calling for public bids for the acquisition of the subject Concert Steinway CD 128 Piano. The City further finds the purchase is clearly and legitimately limited to a single source or supply and that the piano is subject to special market conditions.
