3 . The Hearing Examiner has jurisdiction to determine the <br /> appropriateness of an application of the Zoning Code pursuant to <br /> Title 19 EMC; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> EVERETT That: <br /> 1 . The City Council does not agree with the Planning <br /> Department' s determination that the proposed juvenile facility is <br /> a permitted use in the C-2 Zone. However, the City Council does <br /> not have the authority to consider the zoning issue at this time. <br /> Therefore, the zoning issue raised by the Appellant concerning <br /> whether the proposed juvenile facility is a permitted use in the <br /> C-2 Zone is remanded to the Hearing Examiner for his <br /> consideration in conjunction with or prior to his consideration <br /> of the SPU permit; and <br /> 2 . There was inadequate information provided to the City <br /> Council concerning the impact of the proposed facility on public <br /> safety, public services, social services, site alterations, <br /> steep-sensitive slopes, impact on neighborhoods, park and trail <br /> impacts, and site contamination. Consequently, the MDNS is <br /> hereby remanded to the Responsible Official to generate <br /> additional information concerning these matters . Once this <br /> information is acquired, the Responsible Official is hereby <br /> directed to return the MDNS appeal to the City Council along with <br /> the additional information for Council ' s further deliberation in <br /> this matter. <br /> Councilman Intro ucing Resolution <br /> Passed and Approved this 4th day of August , 1993. <br /> Council President <br /> tesSec.0 <br />
