< A <br /> jj .ELfERETT <br /> RESOLUTION NO. 3812 <br /> A RESOLUTION authorizing the release of interim traffic <br /> mitigation fees for the Central Business District. <br /> Whereas, the City Council finds that the City adopted an interim <br /> traffic mitigation policy through the adoption of Ordinance No . <br /> 1670-89 as amended; and <br /> Whereas, the City Council finds that the policy was recently <br /> amended by the adoption of Ordinance No. 1910-92 to exempt from <br /> the requirements of the policy development in the Central <br /> Business District; and <br /> Whereas, the City Council finds that prior to the adoption of the <br /> recent amendment only one property owner paid mitigation fees for <br /> development in the Central Business District; and <br /> Whereas, the City Council finds that the interim traffic policy <br /> requires that the City either expend or obligate the fees <br /> collected within five years of collection or return said fees <br /> with interest; and <br /> Whereas, the City Council finds that since fees are no longer <br /> collected for the Central Business District for interim traffic <br /> mitigation, it is appropriate to return those fees previously <br /> collected; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> EVERETT THAT interim traffic mitigation fees collected for the <br /> Central Business District prior to , adoption of Ordinance No. <br /> 1910-92 be refunded at this time. <br /> Cottnci.lman Introducing Resolution <br /> PASSED AND APPROVED this 28th day of Jul , 1993 . <br /> COUNCIL PRESI• ;- <br /> restrmt <br />
