A°11 <br /> ELSRETT <br /> RESOLUTION NO. 3792 <br /> A RESOLUTION DENYING THE APPEALS OF ED RUBATINO AND <br /> THE GREATER RIVERSIDE NEIGHBORHOOD GROUP AND UPHOLDING THE <br /> DECISION OF THE HEARING EXAMINER <br /> SPECIAL PROPERTY USE PERMIT #1-92 <br /> WHEREAS, Ed Rubatino and the Greater Riverside Neighborhood Group filed <br /> appeals of the Hearing Examiner's decision relating to issuance of a Special Property Use <br /> Permit (SPU #1-92); and <br /> WHEREAS, pursuant to Chapter 2.23.200 E.M.C., the City Council did hold a public <br /> meeting; and <br /> WHEREAS, the City Council reviewed the record of the Hearing Examiner and heard <br /> statements from the appellants and city staff concerning the appeal; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br /> CITY OF EVERETT that the Hearing Examiner's record contains no erroneous procedure or <br /> substantial error in fact or law, and therefore Council denies the appeal and incorporates by <br /> reference the Findings and Conclusions of the Hearing Examiner's Decision dated March 11, <br /> 1993. <br /> 0.1( <br /> Cou person Introducing Resolution <br /> Passed and Approved this 2nd day of June, 1993 <br /> / i r <br /> Col. ---ane-c.
