December 2, 1985 <br /> John and Molly Klipp <br /> 108 - 79th Place S.E. <br /> Everett, WA 98203 <br /> Re: Application for Home Occupation Permit e v e re tt <br /> Dear Mr. and Mrs. Klipp: ""L" °fl"y <br /> .! <br /> IT WASM CjJO I <br /> 'A 2", <br /> After reviewing your application for a Home Occupation Permit, the City has p <br /> determined that you do not meet the general requirements to qualify as a Home <br /> Occupation and so hereby denies your request for a Home Occupation Permit. <br /> Everett Municipal Code (E.M.C. 19.114.020 (C) (Chapter 19.44 enclosed) states, "No <br /> receipt or distrioution of products shall be permitted except as is commonly <br /> anticipated in residential areas, it being the intent of this section to prohibit <br /> excessive truck traffic on residential, non-arterial streets." <br /> Your application states that two United Parcel Service deliveries are made daily <br /> which cannot be considered, " . . . commonly anticipated in residential areas . . . " <br /> In addition, your application states that training sessions for four to six people <br /> (maximum ten) will be held in your home twice a week. E.M.C. 19.44.020 (D) states, <br /> "No person other than the occupant of the dwelling shall be employed on the <br /> premises,-' and even though these may not technically be "employed," still, the <br /> intent of this section is to limit the intensity of business use, i.e. Home <br /> Occupation, in a residential area, and so the training sessions exceed the intent of <br /> this section. <br /> "The impact of the use on the residential character of the area from the standpoint <br /> of aesthetics, privacy, nuisance, traffic and the overall integrity of the <br /> residential neighborhood," (E.M.C. 19.44.030 (A) are also considered in making a <br /> determination on the application and the amount of traffic generated by your use, <br /> both delivery of merchandise and consultant traffic, would not appear to be <br /> compatible with the residential character of the neighborhood. <br /> For the above reasons, the City has denied your request for a Home Occupation <br /> Permit. In the event you disagree with this decision, you have the opportunity to <br /> appeal to the Hearing Examiner. Instructions are enclosed.
