SIDEWALK REPLACEMENT PROGRAM POLICY <br /> The current Everett Municipal Code 13.08.010 identifies that the property <br /> owner is responsible to repair and maintain the abutting sidewalk. The <br /> street element of the Utility Division has been operating under a policy which <br /> offers to residential and business property owners assistance with repair or <br /> sidewalk replacement through a property owner participation program. The <br /> program essentially offers the property owner repairs or replacement of the <br /> sidewalk constructed with City labor and equipment if the property owner <br /> contributes the cost of the concrete. <br /> This program will repair or replace those sidewalks that pose safety problems <br /> for residential or business property owners that request to participate in the <br /> program. Low income senior or disabled residents that conform to RCW <br /> 84.36.381, 383 and 14.18.020 may qualify for the program at no cost. <br /> The replacement part of the program will prioritize the replacement projects. <br /> The list will be readjusted as needed to prioritize list. This effort will <br /> improve safety for pedestrians while improving the neighborhood aesthetics. <br /> Chapter 13.08 <br /> SIDEWALK MAINTENANCE <br /> 13.08.010 Maintenance of sidewalks—Duty of abutting property owners. <br /> Whenever any street, lane, square,place or alley in the city has been improved by the <br /> construction of sidewalk or sidewalks along either or both sides thereof,the duty, burden, and <br /> expense of repair,renewal, maintenance,and removal of obstructions and snow from such <br /> sidewalk or sidewalks shall be to the property owner directly abutting upon that side of such street <br /> along which the said sidewalk has been constructed. (Ord. 322-74§ 1, 1974) <br /> 13.08.020 Snow or ice—To be removed by noon. <br /> The owner, agent,occupant or person in charge of each and every tenement, building or vacant <br /> property fronting upon or adjoining any street on which sidewalks exist shall clean by noon the <br /> sidewalk in front of or adjoining such building, or unoccupied lot or building,as the case may be, <br /> of snow or ice to the width of said sidewalk and cause the same to be kept clean from snow or <br /> ice.
