In the "event the PERMITTEr should fail to pay for <br />such Storage and redeem the property within one hundred (100) days <br />the Stw-age yard is hereby given authority t:o sell such properly in <br />the open market through advertised bidding by givi.�g notice in a <br />newspaper of general circulation in the City of Everett, not less <br />than ten (10) days beforc.such sale. Such sale shall be made to <br />the highest bidder. Proceeds from such sale shall first be applied <br />t° reimburse the storage+ yard for. any' cxpense t}tat it may have <br />incurred. If there is any remaining amount left, then next the <br />CITY shall be reimbursed for any expenses'i.t may have incurred over <br />and above the cash bond deposited by the PEPJfITTJiE in the event <br />such caa:h bond is insufficient to cover the CITY'S cost. In the event the PEMITTIM <br />amremoves.it at his own <br />eXpcnse as required, then the CITY shall reimburse the PERl9ITTT.L' <br />the amount of such cash bond.. <br />VII <br />In consideration of the granting of the above permit, and <br />granting the use of a commercial 'coach, mobile home, or other <br />Portable unit, the PL•'RlITTEE agrees to waive any, cause of action <br />against either the CITY or any of its officers and 'employees because of any defect in the construction or installation of any <br />commercial coach, mobile home, or other portable unit, or for any <br />connectiou to. or disconnection from any utilities which may cause <br />damage whatsoever to the premises, any other premises, or anv <br />person or persons, and the undersigned further agrees to hold the <br />CITY, or any of its officers and employees harmless from any <br />liability caused by such'.usc.. <br />VIIl <br />failure to comply with any provisions of this agreement shall accelerate the time in which the PERI.IITTEE shall be required to <br />remove such commercial coach, mobile home, or other portable unit <br />the time that such -✓iolation is co;mnit:ted, providing that the <br />PUPUT'J'EE Shall have ten (10) days to correct such violation from <br />i-bc time -the notice is given by the Building Official.
