One of the conditions on the declaration of <br />nonsignificance for Casino Road No. 1 was a condition that <br />the developer pay a sewr.r system upgrading fee of $170.00 <br />per unit. We believe that 821 Associates has several <br />legitimate legal grounds which it can advance which indicate <br />that this assessment is illegal, ultra vices, and unconsti- <br />tutional. However, in order to expedite the further develop- <br />ment of this project, and in particular, to enable side <br />sewer permits to be issued, we are enclosing a check drawn <br />on the account of 821 Associates, dated September 9, 1930 <br />(check #060370), in the amount of $42,433.63, which includes <br />fees for the trunkl.ine, sewer permits, and the special <br />assessment at $170.00 per unit for 260 units. <br />The enclosed special assessment is paid under protest, <br />and 821 Associates reserves all of its rights to assert the <br />invalidity of such a special assessment. <br />We also represent Kenton Associates, the developer of <br />Casino Road Apartments No. 2. It is our further under- <br />standing that a fee of $219.00 per unit will be assessed by <br />the City in connection with the development of Casino Road <br />
