N : <br />rl a <br />WHEREAS, Ordinance No. 556-78 was enacted to a �y <br />BEPIR� <br />O development in the vicinity of Casino Road between Ever een <br />N <br />O Way and Airport Road to proceed while, at the same time, <br />O <br />co creating a process to mitigate the traffic :impact upon <br />Casino Road generated by the development to be constructed <br />along Casino Road; and <br />WHEREAS, Ordinance No. 556-78 requires, in part, a <br />developer convey and execute in the favor of the City of <br />Everett an irrevocable power of attorney for the sole purpose <br />of casting a vote, signing a petition or otherwise assenting <br />to the formation of a Local Improvement District. <br />NOW, THEREFORE, in consideration of participating in <br />the procedure established by Ordinance No. 556-78 and thereby <br />mitigating the adverse traffic impacts of its development <br />upon Casino Road, Kenton A::sociates, a general partnership, <br />(hereinafter referred to as "Developer"), and pursuant to <br />Ordinance Vc. 556-78 and the agreement dated thez_7_tb day of <br />June , 1980, between Developer and the City of Everett, <br />a municipal corporation (hereinafter referred to as "City"), <br />Developer has made, constituted and appointed and by these <br />presents does make, constitute and appoint the City as true <br />I <br />and lawful attorney for .it and in its name, place and stead, <br />and as an irrevocable proxy to cast a vote for approval, by <br />petition or otherwise, of any Local Improvement District <br />hereafter formed by the City, its successor or other property <br />owners in a benefit area encompassing Casino Road for. ultimate <br />Istreet and related improvements pursuant to Ordinance No. <br />! 556-78, as it presently exists or is hereafter amended or <br />supplanted. <br />This Power of Attorney shall be a conveyance of an <br />irrevocable interest in and the Developer does by these <br />LIU <br />
