EXHIBIT "A" <br />That portion of the Northeast quarter of the Northwest <br />quarter of Section 13, Township 28 North, Range 4 East, <br />W.N., lying northerly and westerly of the following described <br />line: <br />Beginning at the North quarter corner of said Section 13: <br />thence S 00°24'43" W 40.00 feet; thence N 89°35'17" W parallel <br />to the North line of said Northwest quarter 300.89 feet to <br />the True Point of Beginning of the herein described line; <br />thence S 63150'49" W 11.18 feet to the beginning of a circular <br />curve to the left having a radius of 22.50 feet, the center of <br />said curve bearing S 00024143" W from the curve beginning; <br />thence southwesterly 35.42 feet along the arc of said curve <br />through a central angle of 90,19116"; thence S 26°39'21" W <br />10.06 feet to the easterly right-of-way line of 5th Avenue <br />West (1[erdeson Road) and the terminus of the herein described <br />line. <br />LESS any pnrtion previously deeded to Snohomish County or <br />the City of Everett for roads. <br />SUBJECT TO: Easements and the terms and conditions thereof <br />disclosed by instruments recorded under Snohomish County <br />Recording Nos. 8005140195, 6006260227, 8009110233 and 8108250179; <br />Waiver of claims of damages contained in instruments recorded <br />under Snohomish County Recording Nos. 401678 and 509802; <br />Power of Attorney disclosed by instrument recorded under <br />Snohomish County Recording No. 8103170179; lease disclosed <br />by instrument recorded under Snohomish County Recording No. <br />8010030247; and assessments levied or to be levied under <br />City of Everett's LID Nos. 703 and 709. <br />EXCEPT THAT the Grantor herein reserves for itself, its <br />heirs, successors, grantees and assigns, the right of reasonable <br />access to said highway. <br />TOGETHER WITF the right to mak.e reasonable, necessary, <br />slopes for cuts and/or fills over, under and upon the adjoining <br />lands of Grantor, its heirs, successors, and assigns, with <br />respect and limited to the street, roadway, and right-of-way <br />constructed upon the property conveyed hereunder. <br />It is expressly intended that these covenants, burdens, and <br />restrictions shall run with the land described herein and <br />shall forever bind the Grantor, its successors and assigns. <br />It is understood and agreed that delivery of this Deed is <br />hereby tendered and that the terms and obligations hereto <br />shall not become binding upon the Grantor hereunder unless <br />and until the City of Everett warrants that the granting of <br />this right-of-way will not cause the adjoining properties <br />and the improvements thereon to violate any setback and/or <br />zoning density requirement promulgated by the City of Everett. <br />� <br />vo! 1lJ1, AG(:A. 4 <br />8307 p1, 0216 <br />
