PLANNING DIRECTOR DETERMINATION <br />Fence Modification <br />Review Process I N04-013 <br />INTRODUCTION: The Clof Everett Planning Department has received an application <br />from Line Baleisis, 714-88 Street SE, Everett WA 98208, to retain two existing 6-foot <br />high fences within the front yard s ttback. Section 39.070.A.I of the Everett Zoning <br />Code grants the Planning Director the ability to permit a fence to exceed the maximum <br />allowable height of forty-two inches within the front setback, through Review Process I <br />as described in the City's Local Project Review and Procedures Ordinance. <br />BACKGROUND: Section 39.070.A.1 of the Everett Zoning Code states that the <br />maximum height of fences located within the front yard setback shall not exceed forty- <br />two inches in height unless approved by the Planning Director using the review process <br />described in the City's Local Project Review and Procedures Ordinance. <br />The subject property is located at 714 — 88'h Street SE, in the R-1 Single Family <br />Residential Zone. The property owner has made application for a fence modification to <br />retain two 6-foot tall fences which ara located within the front yard setback. <br />FINDINGS: One fence runs east/west along the properties frontage, parallel to 881h <br />Street. This fence is chainlink, however the western portion of the fence contains <br />passive white slats. A majority of this fence was constructed prior to the applicant <br />owning the property. The intersection to the north of the subject residence is heavily <br />traveled and the fence does provide a reduction in traffic and headlight nuisances. The <br />second fence is located along the eastern property line, running perpendicular to 881h <br />Street. This fence is solid board. The fence provides for greater privacy and separation <br />between the applicants property and the property to the east. The fence does not <br />appear to create a visual sight obstruction for either the subject site or the neighboring <br />property to the east. <br />DECISION: The Planning Director has determined to approve the application for the <br />fence modification based on the following conditions being met: <br />The maximum height of both fences should not exceed 6 feel above the existing <br />grade. <br />This is an administrative decision that may be appealed to the City's Land Use Hearing <br />Examiner.
