ORDINANCE NO. 2902-06 AN ORDINANCE providing for the vacation of that portion of Rockefeller Avenue between 13th and 14th Streets and the north/south alley between 13th and 14th Streets within Block 248, Plat of Fourteenth Street Addition to Everett. WHEREAS, Providence Everett Medical Center (the "Petitioner") did petition for the vacation of certain rights-of-way in the City and the City Council of the City of Everett did, by Resolution No. 5698, duly adopt and fix the 5 day of December, 2005 at 8:30A.M. as the date of public hearing and by City Council action on December 5t', the hearing was continued to December 21st, 2005 at 6:30 P.M. and WHEREAS, due and legal notice of the time and place of said hearing and determination of said Resolution has been given by the City Clerk in the manner prescribed by law; and WHEREAS, at the time and place fixed for hearing, the issues were publicly presented; and WHEREAS, the City Council finds it would not vacate said rights of way if it did not retain easements for utilities in said rights of way to be vacated, as provided for in this ordinance; and WHEREAS, it now appears to the City Council of the City of Everett that the said rights of way resolved to be vacated should be vacated pursuant to the terms and conditions of this ordinance: NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the following described right-of-ways: That portion of Rockefeller Avenue right of way lying between and adjoining Block 247, Plat of Everett Division "R" according to the plat thereof recorded in Volume 6 of Plats, Page 33, and Block 248, Plat of Fourteenth Street Addition to Everett, according to the plat thereof recorded in Volume 10 of Plats, Page 71, both of the above plat references are to be found in the records of Snohomish
