U.S. West NewVector Group, Inc. <br /> SPU 17-91 and Variance 3-92 <br /> Page -3- <br /> FINDINGS OF FACTS <br /> 1. The Applicant requested approval of a Special Property Use Permit for <br /> the construction of a 126 foot, self-supporting monopole steel tower <br /> which would support up to 12 cellular panel antennas. In addition, the <br /> Applicant proposed construction of a 360 square foot maintenance/storage <br /> building and the placement of a four foot diameter microwave dish at the <br /> 90 foot level of the monopole tower. <br /> Further, the Applicant's request includes a variance from the R-1 zone <br /> height standards. <br /> 2. The subject property is zoned R-1, Single-Family Residential Low <br /> Density. <br /> 3. The Everett Zoning Code (EZC) 6.010 establishes a height standard of 28 <br /> feet for structures in R-1 zones. The Applicant seeks a variance from <br /> this standard. <br /> 4. The proposed project will be located at 4504 Broadway which is the <br /> northwest corner of the Evergreen Cemetery. The proposed location is <br /> immediately east of the GTE office building. The portion of the <br /> cemetery that is to be leased by U.S. West NewVector Group, Inc. is <br /> vacant. <br /> 5. The properties to the north and west are zoned Commercial. The <br /> properties to the south are zoned R-1. The property to the south is <br /> developed with single-family residences, while the property to the east <br /> is Broadway Avenue and 1-5. <br /> 6. Pursuant to the State Environmental Policy Act (SEPA) the City of <br /> Everett was designated the lead agency for environmental review. A <br /> Mitigated Determination of Non-Significance (MDNS) was issued for the <br /> project on April 2, 1992. On April 13, 1992, an appeal of the threshold <br /> determination was filed by Mark Stowe on behalf of the Lowell Civic <br /> Association. On June 3, 1992, the Everett City Council voted to deny <br /> the appeal. On July 22, 1992, the Everett City Council passed a <br /> resolution adopting the findings and conclusions for the denial of the <br /> appeal. Included in the appeal review were studies of electromagnetic <br /> fields. <br /> 7. EMC 41.150(D)1(c) requires Special Property Use Permits for the proposed <br /> activity of the Applicant. In order for a Special Property Use Permit <br /> to be granted, the criteria of EMC 41.150.0 must be satisfied. Those <br /> criteria include: <br /> A. A showing of the need of the neighborhood, district, or City for <br /> the proposed Special Property Use; <br /> B. The adequacy of streets, utilities, and public services required <br /> to serve a proposed use; <br />
