rn <br /> INTERLOCAL AGREEMENT <br /> BETWEEN THE CITY OF EVERETT <br /> AND ALDERWOOD WATER AND WASTEWATER DISTRICT <br /> FOR THE PURCHASE OF EQUIPMENT <br /> I. RECITALS <br /> WHEREAS, the City of Everett (City) and the Alderwood Water and Wastewater District <br /> (AWWD) (individually a "Party" and collectively the "Parties") are authorized pursuant to RCW <br /> 39.34 to enter into the Agreement herein; and <br /> WHEREAS, the City and AWWD are authorized pursuant to RCW 39.33.010 to "sell, <br /> transfer, exchange, lease or otherwise dispose any property, real or personal, . . on such terms and <br /> conditions as may be mutually agreed upon by the proper authorities" of the City and of AWWD; <br /> and <br /> WHEREAS, the City desires to purchase surplus water meters from AWWD and AWWD <br /> desires to sell them to the City; <br /> NOW, THEREFORE, in consideration of the terms and provisions herein, it is agreed by <br /> and between the City and AWWD as follows: <br /> II. AGREEMENT <br /> A. Defmitions: <br /> 1. The"City" shall mean the City of Everett, a municipal corporation formed under the <br /> laws of the State of Washington. <br /> 2. "AWWD" shall mean the Alderwood Water and Wastewater District, a municipal <br /> corporation formed under the laws of the State of Washington. <br /> 3. "Meters" shall mean two propeller type water meters currently owned by AWWD, a <br /> 48-inch and 30-inch meter <br /> B. Purpose of Agreement. The purpose of this Agreement is to define the respective <br /> responsibilities of the City and AWWD in order to formalize the City's purchase of the <br /> meters from AWWD. <br /> 1. City's Responsibilities. The City shall remit payment in the amount of$200 (two- <br /> hundred dollars) plus the applicable sales tax to AWWD within 30 days of the <br /> Effective Date of this Agreement.
