3 <br />PLANNING COMMISSION <br />RESOLUTION NO. 10-06 <br />A Resolution Recommending that the City Council Amend the Local Project Review <br />Procedures Ordinance No. 2530-01, as amended (EMC 15.24.080.C), to provide clarification of <br />the public notification requirements for Review Process II. <br />WHEREAS, the City of Everett adopted Ordinance No. 2530-01 to comply with RCW Chapter <br />36.70B concerning Local Project Review Procedures; and <br />WHEREAS, Article II, Chapter 6, Subsection 2(B) of said ordinance, codified as EMC 15.24.080, <br />contains the requirements for public notification for Review Process II, Administrative <br />Decisions; and <br />WHEREAS, EMC 15.24.080.0 requires notice to be mailed to contiguous property owners; and <br />WHEREAS, Title 15 does not define contiguous, and there have been instances where property <br />owners across a street or alley have not been notified of a pending administrative land use <br />action even though their properties were potentially impacted by such land use actions; and <br />WHEREAS, the Planning Commission held a public hearing on May 4, 2010 to consider public <br />testimony and make a recommendation concerning regulations for public notice for <br />administrative land use decisions and finds that public notice for Review Process II <br />administrative decisions should be provided more consistently to nearby property owners; and <br />WHEREAS, the Planning Commission finds: <br />1. The proposed amendment is consistent with the applicable provisions of the Everett <br />Growth Management Comprehensive Plan; and <br />2. The proposed amendment bears a substantial relation to the public health, safety and <br />welfare; and <br />3. The proposed amendment promotes the best long term interests of the Everett <br />community. <br />3P <br />
