4 <br />NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br />Section 1: Amendment of the Land Use Map of the Comprehensive Plan. <br />The Comprehensive Plan land use map designation of the property located at 2222 52nd Street is <br />hereby amended from 1.3 (Single Family Residential) to 4.2 (Community Business), as depicted <br />in Exhibit A, amending Ordinance No. 2021-94, as amended. <br />Section 2: Approval of Rezone. <br />Section 2.020 of Ordinance No. 1671-89, as amended (EMC 19.02.020), is hereby amended: <br />The zoning of the subject site is hereby changed from R-2 (Single Family Residential) to B-2 <br />(Community Business), as depicted in Exhibit B, and as legally described in Exhibit C, subject to <br />conditions this Ordinance and the Development Agreement attached hereto and incorporated <br />herein as Exhibit D. <br />Section 3: Conditions of Approval <br />1. Use of the site and the current or future structure(s) on it shall be subject to conditions and <br />requirements of the Development Agreement attached hereto as Exhibit D and incorporated <br />herein by reference. <br />2. The intent of the conditions of this Ordinance and the Development Agreement is that while <br />the structure(s) on this site may be used as office space, its appearance including the structure(s), <br />the parcel (yard), and parking, shall remain "residential" in appearance, so as to protect the <br />affected nearby residential neighborhood from non-residential intrusion. <br />3. Exhibits A, B, C and D are hereby made part of this approval and incorporated herein by <br />reference. <br />4. The Mayor is hereby authorized to execute the Development Agreement (Exhibit D). <br />Section 4: The legal description of the area affected by this action is described in Exhibit C which <br />is attached hereto and incorporated herein by reference <br />Section 5. Validity. <br />Should any section, subsection, paragraph, sentence, clause or phrase set forth in this Ordinance or its <br />application to any person or situation be declared unconstitutional or invalid for any reason, such <br />decision shall not affect the validity of the remaining portions of this Ordinance, or its application to any <br />other person or situation. The City Council of the City of Everett hereby declares that it would have <br />adopted this Ordinance and each section, subsection, sentence, clause, phrase or portion thereof <br />41 -3- <br />
