J <br />ORDINANCE NO. <br />An Ordinance relating to the operation of the Everpark Garage, amending Ordinance <br />No. 849-82, as amended <br />Whereas, RCW 35.86.040 authorizes cities to establish by ordinance the method of <br />operation of off-street parking; and <br />Whereas, the Everpark Garage is situated on real property owned in fee by the City; and <br />Whereas, the Everpark Garage is an off-street parking facility open to the general public <br />to serve civic center purposes; and <br />Whereas, the City Council decided in 1982, at or near the time it passed Ordinance No. <br />849-82, that for the purposes of the Everpark Garage, the City will not establish a <br />parking commission nor operate that off-street parking facility with City staff, and <br />Whereas, Ordinance No. 849-82 ordained that the Everpark Garage shall be operated by <br />a private operator through a management agreement or through a lease agreement <br />executed with the City; and <br />Whereas, based on the results of a request for proposals process the City has contracted <br />with a private operator to manage the Everpark Garage and found this to be an effective <br />way to manage the Everpark Garage; <br />NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br />Section 1. Section 2 of Ordinance No. 849-82, as amended by Ordinance No. 2998-07 <br />which reads as follows: <br />The management agreement shall be for a term not to exceed six (6) years. <br />Is hereby amended to read as follows: <br />The management agreement shall be for a term defined in the management <br />contract. <br />56 <br />1 <br />
