• <br /> by <br /> AMENDMENT NO. 2 TO PROFESSIONAL SERVICES AGREEMENT BETWEEN <br /> THE CITY OF EVERETT <br /> AND <br /> DYKEMAN,ARCHITECTS,P.S. <br /> WHEREAS, Dykeman Architects P.S. and the City entered into an Agreement dated November <br /> 7, 2007 (Agreement")to provide services for the Key Bank Building shell improvements as <br /> described in the Scope of Work(Agreement Exhibit"A") for the Kid's Stage Shell <br /> Improvements of the Key Bank located on the Northwest Corner of California and Wetmore; and <br /> WHEREAS, the parties agree to amend the Agreement to on July 6, 2009 to extend the time to <br /> support construction and administration services of the project; and <br /> WHEREAS, additional design services was increased due to re-starting project and incurring <br /> additional costs for services for review of added requirements, fine tuning scope of work, <br /> resetting of new parameters set by owner, coordination of HazMat related work, and changes to <br /> civil, mechanical, structural and electrical construction requirements, and documents/drawings; <br /> and <br /> WHEREAS, the total amount of compensation stated in the agreement as is likely insufficient <br /> due to the additional services provided by Architects and Consultants for the remainder of the <br /> project and as additional $16,994.00 of contract value is needed to complete the project; and <br /> WHEREAS, the City and Dykeman Architects P.S. agree to amend their Agreement to; increase <br /> the maximum compensation by an additional $16,994.00 from the current contract level of <br /> $122,500.00 to $139,494.00 <br /> NOW THEREFORE, the City of Everett and Dykeman Architects P.S. agree to amend and <br /> modify the Agreement as follows: <br /> 1. Paragraph 4, Section D is modified to read as follows: <br /> Total compensation, including all services and expenses, shall not exceed a maximum of <br /> One Hundred Thirty-Five Dollars ($139, 494.00). <br /> 2.
