5 <br /> elements of the projects or activities described in this Agreement. Ownership and <br /> jurisdiction of all such facilities shall remain with the CITY. <br /> C. The CITY is self-insured with a retention level of$1 million. Above that level the <br /> CITY has excess liability coverage. <br /> D. The COUNTY is self-insured with a retention level of$1 million. Above that level <br /> the COUNTY has excess liability coverage. <br /> E. In the event of liability for damages arising out of bodily injury to persons or <br /> damages to property caused by or resulting from the concurrent negligence of the <br /> COUNTY and the CITY, its officers, employees, and volunteers, the COUNTY's <br /> liability hereunder shall be only to the extent.of the COUNTY negligence. It is <br /> further specifically and expressly understood that the indemnification provided herein <br /> constitutes both the COUNTY's and the CITY's waiver of immunity under <br /> Industrial Insurance, Title 51 RCW, solely for purposes of this indemnification. This <br /> waiver has been mutually negotiated by the parties. The provisions of this section <br /> shall survive the expiration or termination of this Agreement. <br /> 9. Commencement, Duration, and Renewal <br /> A. This Agreement shall become effective following execution by all parties and upon <br /> the date of the last signature below. This Agreement shall remain in effect, unless <br /> otherwise terminated as provided in Section 16 of this Agreement, for a term of six <br /> (6) years; PROVIDED that the COUNTY's obligations after December 31, 2010 are <br /> contingent upon local legislative appropriation of necessary funds in accordance with <br /> applicable laws and the Snohomish County Charter. <br /> B. This Agreement may be renewed for additional terms of six (6) years if, at or prior to <br /> its termination date, the parties agree in writing to such renewals. Any renewal must <br /> be executed with the same formalities as this document. <br /> 10. Interlocal Cooperation Act, Ch. 39.34 RCW <br /> The parties agree that no separate legal or administrative entities are necessary to carry <br /> out this Agreement. Further, except as expressly provided to the contrary in this <br /> Agreement, any real or personal property used or acquired by either party in connection <br /> with the performance of this Agreement will remain the sole property of such party, and <br /> the other party shall have no interest therein. <br /> 11.
