4 <br /> NOW,THEREFORE,the CITY and the CONSULTANT mutually agree as follows: <br /> Section 1 of the Agreement is modified to change"Exhibit A and A-1 — Scope of Work" <br /> to Exhibit A,A-1, and A-2—Scope of Work." <br /> Section 4B of the Agreement is modified to change "Exhibit B and B-1 - Compensation" <br /> to Exhibit B, B-1 and B-2 -Compensation." <br /> Section 4D of the Agreement is modified to change the total compensation, including all. <br /> services and expenses from a not to exceed maximum of Two Hundred Nine Thousand <br /> Four Hundred Sixty Three Dollars ($209,463.00) to a not to exceed maximum of Two <br /> Hundred Sixty Nine Thousand Five Hundred Sixty One Dollars ($269,561.00). <br /> Section 6 of the Agreement is modified to change"Exhibit A and A-1 — Scope of Work" <br /> to "Exhibit A, A-1 and A-2—Scope of Work." <br /> Exhibit A and A-1 Scope of Work to the Agreement is modified(attached as Exhibit A-2 <br /> — Scope of Work) to add additional services to the design development and construction <br /> document phases to coordinate and develop revisions to civil, mechanical and electrical <br /> phases resulting from changes to the project as a result of project re-initiation; and to add <br /> new services for design development and construction document development in order to <br /> install vaults, grounds, conduits, secondary wire and to restore power as a result of the <br /> undergrounding of utilities in the adjacent alley to the west of the downtown plaza site. <br /> Exhibit B Compensation to the Agreement is modified (attached as Exhibit B-2 — <br /> Compensation) to increase fee payment for additional services related to design <br /> development and construction document development and for new services required as a <br /> result of the undergrounding of utilities in the adjacent alley to the west of the downtown <br /> plaza site. The additional services increase the not to exceed amount of the contract from <br /> Two Hundred Nine Thousand Four Hundred Sixty Three Dollars ($209,463.00) to an <br /> amount not to exceed Two Hundred Sixty Nine Thousand Five Hundred Sixty One <br /> Dollars ($269,561.00) <br /> All other terms and conditions of the agreement, as amended, shall remain in full force <br /> and effect. <br /> IN WITNESS WHEREOF, the CONSULTANT and the CITY have executed this <br /> Agreement as of the day and year first above written. <br /> 2 <br /> 41 <br />
