lillW <br /> Tgirv,/- <br /> V---A <br /> EVERETT <br /> RESOLUTION NO. 3592 <br /> RESOLUTION OF INTENT TO REZONE AND PERFORMANCE AGREEMENT <br /> CASINO RIDGE APARTMENTS <br /> A Resolution of the City of Everett Approving a Development <br /> Proposal Located South of SR 526, North of Casino Road, East of <br /> Hardeson Road and West of Upper Ridge Road, and Setting Forth <br /> Conditions to Which the Development Proposal shall be Subject, <br /> and Declaring Its Intent to Rezone said Property from R-3 PRD <br /> (Multi-Family Medium Density Planned Residential Development) to <br /> R-3 (Multi-Family Medium Density Residential) upon Approved <br /> Completion of Certain Specified Improvements on Property which is <br /> Proposed to be Rezoned <br /> WHEREAS, ROYAL FLUSH PARTNERSHIP represented by Marianne <br /> Christian-Griffith, has filed an application to rezone property <br /> located south of SR 526 , north of Casino Road, east of Hardeson <br /> Road and west of Upper Ridge Road from R-3 PRD (Multi-Family <br /> Medium Density Planned Residential Development) to R-3 <br /> (Multi-Family Medium Density Residential) for the purpose of <br /> developing a 36 unit apartment complex; and <br /> WHEREAS, the Hearing Examiner after public hearing, review <br /> of the Revised Mitigated Determination of Non-Significance (MDNS) <br /> and consideration of the recommendation of the Planning <br /> Department, adopted certain Findings and did recommend to the <br /> City Council that the proposed rezone be approved pursuant to the <br /> provisions of Section 41 . 160.D.7 of Ordinance 1671-89, as <br /> amended, and subject to the specific conditions set forth in said <br /> recommendation; and <br /> WHEREAS, the R-3 zone includes a height limitation of 35 <br /> feet above the base elevation of the site; and up to 30 feet of <br /> fill was placed on the subject site during the construction of <br /> SR-526 and Casino Road; and the Hearing Examiner granted a <br /> variance to allow the height of the proposed buildings to be 35 <br /> feet above the existing grade of the site based upon review of <br /> the proposed development site plan; and <br /> WHEREAS, the City of Everett, hereinafter referred to as <br /> "City" , finds that by establishing certain standards for the <br /> development of the site proposed to be rezoned, that a feasible <br /> multiple family project can be constructed on the site while <br /> adequately protecting the surrounding properties from the impacts <br /> of the apartment use on the property to be rezoned; and <br />
