1111111 <br /> RESOLUTION 3538 E!/E?ETT <br /> SOCIAL SERVICES ADMINISTRATION (BEIGHTON) SPECIAL PROPERTY USE <br /> FOR GOVERNMENT SERVICES OUTSIDE THE B-3 CENTRAL BUSINESS DISTRICT <br /> IN AN R-5 C-0 MULTI-FAMILY RESIDENTIAL DISTRICT <br /> WITH A CLINIC-OFFICE OVERLAY ZONE <br /> WHEREAS, application was made on May 22, 1991, by GayLynn Beighton, <br /> representative of property owners, for the purpose of providing space for a <br /> government service in an existing building at 3202 Colby Avenue for a Special <br /> Property Use Permit; and <br /> WHEREAS, a Public Hearing was held before the Hearing Examiner on July 11, <br /> 1991; and <br /> WHEREAS, the Hearing Examiner made findings, conclusions, and a decision July <br /> 25, 1991; and <br /> WHEREAS, a request was made that the Hearing Examiner reconsider his decision <br /> and a request was made to clarify the record; and <br /> WHEREAS, the Hearing Examiner issued an Order amending the Finding of Facts, <br /> clarified conditions and denied the request for reconsideration; and <br /> WHEREAS, the City Council, under the authority of EMC 2.23.200 "appeal of <br /> examiner's decision" considered the appeal of the Hearing Examiner's Decision <br /> granting a Special Property Use for Social Security Administration (Beighton) <br /> at a public City Council meeting held September 18, 1991, <br /> WHEREAS, the City Council reviewed the documents and examined the same at that <br /> public meeting, and <br /> WHEREAS, the City Council determined that no erroneous procedure or <br /> substantial error in fact or law existed; <br /> NOW THEREFORE, the City Council affirms the decision of the Hearing Examiner <br /> which granted the Special Property Use with conditions and thereby denys the <br /> appeal. <br /> Aa <br /> bkh, <br /> ouncilperson Introducing Resolution <br /> Passed and Adopted this 9th date of October , 1991. <br /> eekaaa 71/1Ml414P <br /> Council President <br /> 1036dm/rb <br />
