• The decision of the Responsible Official is supported by the record. <br /> Decision: <br /> Deny the appeal and affirm the mitigation requirements for surface water in the Decision Document, <br /> including requirements pertaining to the operation of the sand peat filter, water quality monitoring, and <br /> maintenance of on-site water quality control systems (Decision Document, Section V, A. General Mitigation (4) <br /> Surface Water, Conditions C &D). <br /> SECTION 9: WETLANDS & STREAMS AS PART OF SURFACE WATER MITIGATION <br /> Findings: <br /> e The Proposed Master Development Plan did include the construction of drainage <br /> detention facilities within two intermittent tributaries (A and B) of Japanese Creek. The <br /> proposed detention facilities also would have resulted in the elimination of Wetland K, <br /> and potentially impacted wetlands H and L (see DEIS Fig. 2-5: Master Plan; pp 2-15 to 2.16 & <br /> FEIS Fig. 3.2-6; also, see FEIS pg 3-31). <br /> • The Decision Document requires that these intermittent tributaries and the riparian <br /> wetlands adjacent to Tributary A be preserved and buffers of native vegetation be <br /> provided, as required by Section 37 of the City's Zoning Code (Environmentally <br /> Sensitive Areas). Tributaries C and D can be modified only if specific approval is <br /> granted by the Planning Director consistent with the City's Environmentally Sensitive <br /> Areas Regulations (Decision Document pp 21-22). The Decision Document includes the <br /> following specific requirements: <br /> - Stream Corridor A is a Category III stream, which contains riparian wetlands H, <br /> I, K and L. Culverting or development within the stream is not permitted. The <br /> stream and associated wetlands shall be preserved and a buffer of native <br /> vegetation adjacent to the stream and wetlands shall be provided (37.220.B.3). <br /> That buffer must be fifty (50) feet wide per Subsection 37.100.A.2 and <br /> 37.150.B.4 of the City Zoning Code as measured from the top of each side of the <br /> stream bank or edge of the wetland, whichever is greater. Per Subsection <br /> 37.150.B.6, if the stream is near a slope equal to or greater than twenty-five <br /> percent (25%) the buffer shall be the greater of fifty (50) feet from the top of the <br /> stream bank or twenty-five (25) feet beyond the top of the slope, as defined in <br /> Subsection 4.010.A.169.B of the Zoning Code. <br /> - Stream Corridor B is a Category III stream which shall be preserved and a buffer <br /> of native vegetation adjacent to the stream shall be provided. That buffer width <br /> must be twenty-five (25) feet per Subsection 37.150.B.4 of the City Zoning Code <br /> 14 <br />
