The Decision Document imposes requirements which provide for mitigation of wetland impacts, (Decision Document, V, a.2 a&b, Wetland Mitigation, pp 12-13), and surface water impacts (Decision Document V, A.4 Surface Water). • The Decision Document imposes all regulatory requirements of Section 37 of the Zoning Code, (Environmentally Sensitive Areas) to the Boeing Master Development Plan. • The Decision Document requires substantial modifications of the Proposed Master Development Plan to relocate drainage detention facilities proposed in intermittent tributaries A and B outside environmentally sensitive areas. • No surface water detention facilities are permitted within stream or seasonal stream corridors or their associated buffers. • All vegetated swales are required to be located outside the wetlands and wetland buffers except for necescary crossings to discharge treated surface water. • The mitigation of wetland impacts is entirely separate from water quality requirements which apply to the treatment of surface water. • The record supports the decision of the Responsible Official; appellants have not demonstrated that the decision is unreasonable or should be modified. Decision: Except for the addition of the mitigation requirements recommended below, deny the appeal and affirm the mitigation requirements for the location of surface water detention facilities and the stream and wetland mitigation requirements as set forth by the Responsible Official in Section V.B.2, Sub-area 2A(1) Streams and Wetlands, Mitigation Requirements i. through ix (see Decision Document pp 20-23). Also affirm the mitigation requirements for vegetated swales as set forth by the Responsible Official in the Decision Document, Section V.A.4. Surface Water b. (p 14). Affirm the wetland mitigation requirements as set forth by the Responsible Official in the Decision Document in Section V.A.2 Environmentally Sensitive Areas, Mitigation Items a. Wetland Mitigation and b. For additional clarification, add the following language to Section V.A.4. of the Decision Document: • Wetlands, stream or seasonal stream corridors, and their associated buffers shall not be used for drainage detention facilities, or vegetated swales, except for necessary crossings of the buffer to discharge treated surface water. 16
