EVEJFETT <br /> RESOLUTION NO. 3493 <br /> A RESOLUTION of the City of Everett, Washington, <br /> accepting the proposal of Colby Square Partners as <br /> the most advantageous proposal for the Design, <br /> Construction and Lease with option to purchase of <br /> the Everett Community Theater received pursuant to <br /> a Request for Proposal; authorizing the execution <br /> of a construction contract and lease; and making <br /> certain findings. <br /> WHEREAS, the City of Everett ("City") has heretofore issued a <br /> Request for Qualifications and a Request for Proposal for design, <br /> construction and lease to the City with option to purchase of the <br /> City of Everett Community Theater by publication of notice <br /> thereof as required by law and by issuance of general and <br /> programmatic requirements for said project in the documents <br /> entitled Request for Qualifications (RFQ) issued December 24 , <br /> 1990, City of Everett Community Theater Step 1; and City of <br /> Everett Community Theater Step 2 , Request for Proposal (RFP) <br /> issued March 14, 1991, by ORB Organization, Inc. ; and <br /> WHEREAS, in accordance with said RFQ statements were received and <br /> opened on March 7 , 1991, and thereafter in response to the RFP, <br /> one qualified proposer submitted a proposal on May 30, 1991; and <br /> WHEREAS, Community Theater Committee, ORB and City staff and the <br /> Mayor have reviewed such proposal and found it to be acceptable <br /> to the City; and <br /> WHEREAS, the RFP contemplates that upon successful completion of <br /> construction of the Community Theater, the City will occupy said <br /> improvements and commence paying lease rental for the use thereof <br /> for a term of years but no such rental obligation shall commence <br /> unless and until the improvements are satisfactorily designed and <br /> constructed by the proposer and are accepted by the City; and <br /> WHEREAS, the RFP contemplates that in order to accomplish the <br /> project, the City and the successful proposer, shall, upon <br /> acceptance of the most advantageous proposal, if any, execute a <br /> lease and a construction contract for final design and <br /> construction; and <br /> WHEREAS, the RFP further contemplates that the proposer has the <br /> option to arrange, with City cooperation, a take-out financing <br />
