RESOLUTION NO. <br /> 3487 ` <br /> ` EVERETT <br /> A Resolution Denying Appeal of David Guadalupe <br /> WHEREAS, David Guadalupe's attorney, Franklin C. Butler <br /> submitted a letter requesting an appeal of the Hearing Examiner's <br /> decision; and <br /> WHEREAS, Mr. Butler's letter did not contain the information <br /> required in Chapter 2 .23 .200 E.M.C. including a brief statement as <br /> to how the appellant is aggrieved by the decision; a brief statement <br /> delineating the finding(s) or conclusion(s) appealed; a brief <br /> statement containing explicit exceptions and objections with regard <br /> to the appealed matter; and a statement of the requested relief; and <br /> WHEREAS, the City Council has reviewed the letter of appeal <br /> against the requirements for appeal contained in Chapter 2. 23.200 <br /> E.M.C. ; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF EVERETT, that the appellant did not adhere to the procedures <br /> established in the Everett Municipal Code for perfecting his appeal. <br /> Consequently, the City Council does not have jurisdiction to <br /> entertain the appeal and the appeal is therefore denied. <br /> (7-7 <br /> Councilperson in roducing Resolution <br /> Passed and Approved this /ai day of June, 1991. <br /> di , • s 2i/.
