a <br /> RESOLUTION NO. _ 3466 EVERETT <br /> A RESOLUTION of the City of Everett, Washington, accepting the <br /> bid of Sierra Construction Company, Inc. , as the most <br /> advantageous bid for the construction of Fire Station <br /> Number Two - received pursuant to a call for public bids; <br /> authorizing the execution of a Construction Contract, <br /> Ground Lease, Lease and Commitment Letter in connection <br /> with such construction; and making certain findings. <br /> WHEREAS, the City of Everett ("City" ) has heretofore issued a call for bids <br /> for the construction of Fire Station No. 2, by publication of notice thereof <br /> as required by law and by issuance of specifications for said project in the <br /> document entitled "Fire Station #2; for the City of Everett, 36th Street and <br /> Rucker, Everett, WA, by Finley Architects, AIA" ; and <br /> WHEREAS, in accordance with said call for bids, bids were received and <br /> opened on April 11 , 1991 , at which time two bids were received by the City <br /> of which Sierra Construction Company, Inc. was the low bidder; and <br /> WHEREAS, the Director of Facilities, the Fire Chief and the City Attorney <br /> have reviewed such bid and found it to be acceptable to the City; and <br /> WHEREAS, the call for bids contemplates that Fire Station No. 2 shall be <br /> built upon real property owned by the City to be leased to the successful <br /> bidder, and bidders were therefore directed to include stated ground lease <br /> rental of $100 in their bids submitted to the City; and <br /> WHEREAS, the calls for bids contemplates that upon successful completion of <br /> construction of Fire Station No. 2, the City will occupy said improvements <br /> and commence paying lease rental for the use thereof for a term of years but <br /> no such rental obligation shall commence unless and until the improvements <br /> are satisfactorily completed by the bidder and are accepted by the City; and <br /> WHEREAS, the call for bids contemplates that in order to accomplish such <br /> lease financing, the City and the successful bidder, shall , upon acceptance <br /> of the most advantageous bid, if any, execute a ground lease for the site of <br /> Fire Station No. 2, a lease-back of Fire Station No. 2, and a construction <br /> contract; and <br /> WHEREAS, the call for bids further contemplates that a take-out financing <br /> will occur upon successful completion of construction of Fire Station No. 2, <br /> whereby an underwriter will purchase certain rights, property and interests <br /> of the selected bidder upon successful completion of Fire Station No. 2; <br /> NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVERETT as <br /> follows: <br />
