14 <br /> REVISED <br /> STAFF REPORT TO CITY COUNCIL <br /> ON THE PROPOSED VACATION OF <br /> that portion of 11th Street right of way lying west of Grand Ave <br /> October 25,2010 <br /> Said portion of 11th Street right of way being legally described as: Beginning at the <br /> northwest corner of Lot 16,Block 224,Plat of The Heights Addition to Everett recorded <br /> in Volume 3 of Plats,Page 40,records of Snohomish County, Washington;Thence <br /> easterly along the north line of said Lot 16 and the easterly projection thereof a distance <br /> of 145feet to intersect the west line of Grand Avenue right of way, said west line of <br /> Grand Avenue right of way being resultant of City of Everett Ordinance#89 approved on <br /> January 24, 1894, in which the westerly 10 feet of Grand Avenue was vacated;Thence <br /> northerly and parallel with the east right of way line of Grand Avenue a distance of 80 <br /> feet to intersect the easterly projected south line of Lot 1,Block 213,Plat of The Heights <br /> Addition to Everett; Thence westerly along the easterly projected south line of Lot 1 a <br /> distance of 10 feet more or less to intersect the southeast corner of said Lot 1;Thence <br /> continuing westerly along the south line of Lot la distance of 137.71 feet to intersect the <br /> southwest corner of said Lot 1 and the west line of said Plat of The Heights Addition to <br /> Everett;Thence southerly along the west line of said Plat of The Heights Addition to <br /> Everett a distance of 80 feet to the northwest corner of Lot 16 and the point of beginning. <br /> The proposed vacation contains an area of approximately 11,708 square feet that is zoned R-2H, <br /> Single Family Residential with.Historic Overlay. <br /> FINDINGS OF FACT AND CONCLUSIONS OF LAW: <br /> FINDING: R.C.W. 35.79.010 allows property owners abutting a public right-of-way to <br /> petition for the vacation of said right-of-way, and if said petition represents <br /> more than two-thirds of the property abutting said right-of-way, the legislative <br /> authority shall fix a time and date for said petition to be heard. <br /> CONCLUSION: A valid petition representing 100% of the abutting property owners to the <br /> proposed vacation area was received, and 6:30 P.M. October 6, 2010, was set <br /> as the time and date for said petition to be heard. A continuance of the public <br /> hearing to November 3, 2010,was made at the October 6th public hearing. <br /> FINDING: R.C.W. 35.79.020 requires the City Clerk to give twenty (20) days notice of <br /> pendency of said hearing on the petition by written notice posted in three (3) <br /> of the most public places in the City, and a like notice to be posted in a <br /> conspicuous place on the right-of-way to be vacated. <br /> CONCLUSION: Said notices were posted as required. <br /> 148 <br />
