ORDINANCE NO. <br /> An Ordinance Regulating the Placement and Appearance of Newsracks, Adding <br /> a New Chapter to Title 13 of the Everett Municipal Code. <br /> Whereas, the City of Everett supports the distribution of publications in <br /> public places as contemplated by Article I, Section 5, of the Constitution of the <br /> State of Washington and the First Amendment to the United States Constitution, <br /> without regard to the content of such publications; and <br /> Whereas, the City of Everett has an interest in providing a variety of <br /> publications reasonable access to convenient vending locations in public right-of- <br /> ways, thereby assisting the public's access to a diversity of ideas, opinions, and <br /> information; and <br /> Whereas, the City of Everett has an interest in maintaining the use of <br /> public right-of-ways for travel and transportation and incidental authorized <br /> purposes; and <br /> Whereas, the City of Everett has considered the interests of owners and <br /> occupants of property adjacent to public right-of-ways, while respecting the rights <br /> of all users thereof; and <br /> Whereas, the City of Everett has an interest in preserving and enhancing <br /> the appearance of public right-of-ways, and carrying out design controls in areas <br /> subject thereto; and <br /> Whereas, the regulation of the placement and appearance of newsracks <br /> in Everett is based on concerns with aesthetic values as well as traffic safety, <br /> pedestrian safety, and the City's economic development interests; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Findings adopted <br /> The findings set forth in the above recitals are hereby adopted and incorporated <br /> by reference. Further, the City Council specifically finds that the regulation of the <br /> placement and appearance of newsracks in the City is a valid exercise of police <br /> power. <br /> 31 <br />
