EVERETT CITY COUNCIL AGENDA ITEM COVER SHEET 4
PROJECT TITLE:
An Ordinance Amending the 12-01-10 Briefing COUNCIL BILL# (J (Q I l-
Zoning Code Related to 12-15-10 Action Originating Department Planning
Accessory Dwelling Units, 12-01-10 First Reading Contact Person Allan Giffen
Amending Ordinance No. 12-08-10 Second Reading Phone Number 257-8725
1671-89 (EMC Title 19) 12-15-10 Third Reading FOR AGENDA OF 12-1, 12-8,
12-15-10 Public Hearing 12-15
Initialed by:
Department Head
CAA
Council President
Location Preceding Action Attachments Department(s)Approval
RS, R-1 and R-2 single Council briefings August Ordinance, Planning, Legal
family detached 11 and October 13, 2010; Citizen correspondence
residential zones
Amount Budgeted N/A
Expenditure Required N/A
Budget Remaining N/A
Additional Required N/A
DETAILED SUMMARY STATEMENT:
On December 16, 2009,the Planning Commission recommended that Detached Accessory Dwelling Units
(DADUs) be permitted in single family zones located north of 41St Street. On August 11, 2010, staff briefed
City Council on the Planning Commission recommendation. Council expressed concerns about limiting
DADUs to just one part of the City, and also stated interest in having design standards so DADUs would not
be out of character for their surroundings. On October 13, 2010, staff presented recommended development
and design standards for DADUs. On December 15, 2010, Council will hold a public hearing on the
proposed amendments to the Zoning Code related to accessory dwelling units.
The attached ordinance would allow DADUs in the RS, R-1 and R-2 single family zones only on lots with
vehicular access from an alley, and only when the lot has 1,000 square feet more area than the minimum for
the zone. The ordinance also includes design standards to promote compatibility with the principal dwelling
and neighboring properties. It encourages owners of illegal DADUs to seek permits within two years. The
existing code for attached Accessory Dwelling units (ADUs) would be re-formatted so those requirements
common to both attached and detached ADUs (such as required owner occupancy for either the principal
dwelling or the ADU) are in one section. The ordinance establishes a separate section for attached ADUs
and detached ADUs. The regulations would be relocated from the General Provision chapter to the chapter
containing regulations for single family zones. Existing definitions are amended, and new definitions are
added.
RECOMMENDATION (Exact action requested of Council):
Adopt Ordinance Amending the Zoning Code Related to Accessory Dwelling Units, Amending Ordinance
No. 1671-89 (EMC Title 19) 5 7
