d. The HMP shall identify the specific habitat objectives. The HMP is designed to <br />achieve and include recommendations regarding all actions taken to be necessary to <br />avoid reducing the likelihood that the species will maintain and reproduce over the <br />long term, and/or actions to maintain or enhance the significant features present. <br />e.. A biological assessment which meets the requirements of federal and state agencies <br />may be accepted as meeting these requirements. <br />3. The HMP shall be evaluated by city, state and federal agencies with permit jurisdiction <br />or expertise, as required by this section and the director shall consider all comments <br />submitted by state and federal agencies, and require necessary revisions to the HMP, if <br />any, prior to accepting the HMP as final. <br />4. The Director shall condition approvals of activities allowed within or adjacent to a <br />habitat conservation area or its buffers, as necessary to minimize or mitigate any <br />potential adverse impacts to the habitat conservation area and effected species. <br />Mitigation measures shall be based upon the analysis, conclusions, and <br />recommendations contained in the HMP. At a minimum, all requirements and <br />mitigation measures necessary to avoid reducing the likelihood that the species will <br />maintain and reproduce over the long term shall be required as permit conditions for the <br />development proposal. <br />5. Fish and wildlife habitat conservation areas and their buffers shall be placed in a critical <br />area protective covenant or tract as required by Section 22 (37.220) of this chapter. <br />(This section shall be codified as EMC 19.37.190.) <br />Section 20: Ground water discharge areas. <br />Lots which contain or are affected by springs, seeps or ground water discharge areas shall be <br />evaluated to determine the relationship the discharge has on geologically hazardous areas, <br />wetlands, streams, fish, plant and wildlife habitat areas. An analysis of such features shall be <br />included in the application for development of the subject property. The city may allow <br />modification of such features consistent with the provisions of this chapter related to geological <br />hazards, streams, wetlands, fish, plant, and wildlife habitat areas, as applicable. <br />(This section shall be codified as EMC 19.37.200.) <br />Section 21: Lot area—Lot coverage Permitted number of dwelling units in multiple - <br />family developments. <br />A. Lot Area. The calculation of minimum lot area for lots which contain areas classified as <br />critical areas shall be determined as provided in this section. Lots that include land which <br />is submerged beneath the mean high water mark of lakes and ponds, or Type F streams <br />shall not be permitted to include the submerged portion of the lot in the calculation of lot <br />area. <br />53 <br />
